Needs for tougher Export Control of Mobile Devices? Legal Perspectives on Precaution and preventiveness in Taiwan 's Foreign Trade Act

Abstract

Taiwan had gone through different technological periods: E-Taiwan (“E” stands for Electronic), M-Taiwan (“M” stands for Mobile ), U-Taiwan (“U” stands for Ubiquitious), and the future T-Taiwan (“T” stands for Telematics). These periods represent a remarkable milestone of Taiwan 's mobile communication infrastructure and successful achievement in the information technology industry, but the nature of the information technology itself also exposes ourselves to the greatest dangers we ever had before. Since we conduct the business by importing or exporting of the mobile devices, we can no longer guarantee that there might be possibility that someday some evil people will not use the mobile products intelligently against us or other friendly countries. Thus, tougher export control on mobile devices must be strengthened and reinforced as a way to prevent possible terrorism and potential national enemies. We introduce the concept of precaution and preventiveness against the possible threats from mis-use of the mobile devices and give Taiwan 's legislature a broader speculation in future amendment of the Foreign Trade Act.
